These Terms of Use constitute an agreement between you and International Modern Hospital (“We” or “Us”, as the context may be). There are rules you agree to follow when using www.imh.ae and other related websites and mobile applications with links to these Terms of Use (collectively, the “Site”) including when you ask questions and when you view or input content on or into the Site. The Website is designed to provide useful information about our organization, facilities, services and employment opportunities within International Modern Hospital.
Who We Are
International Modern Hospital (IMH) Dubai, License No. 567344 Type as a Limited Liability Company (LLC) is a tertiary multi-specialty hospital having state-of-the-art facilities and expertise in all the major specialties with capabilities of providing treatment to Medical and Surgical emergencies located at Port Rashid Road, Al Mankhool Area, Bur Dubai P.O. Box: 121735, Dubai UAE.
Disclaimer of Warranties – we do not warrant that access to, use of the Site will be uninterrupted or error-free, or that defects in the Site will be corrected. This Site, including any content or information contained within it or any Service, is provided “as is,” with all faults, with no representations or warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, quality of information, quiet enjoyment, and title/non-infringement. We do not warrant the accuracy, completeness or timeliness of the information obtained through the Site.
TELE/VIDEO CONSULTATION
We offer telehealth services via a video and audio platform to allow our users (“Users”) to provide their medical history and engage licensed doctors (“Platform Doctors”) to obtain medical support (“Services”).
Our Site gives users access to Doctors via video consultation or telephone. Based on the information you provide; licensed medical practitioners will provide an assessment and treatment plan. This section is available for the sole purpose of facilitating communications between health services providers and consumers who choose to use the online service. All information provided on this site or in connection with any communications supported by us, including, without limitation, real-time video, telephone or email communications between professionals utilizing the website and consumers is intended to be for general informational and health educational purposes only. The site is not a substitute for professional medical diagnosis or treatment. Reliance on any information provided by us or any professionals that utilize our site is solely at your own risk.
The Site is not intended for use in a medical emergency or in case of an urgent healthcare need. If appropriate, you may be referred to an alternative setting to receive care. This Site is intended for use only by users who are at least 18 years of age. By proceeding to use the Site you confirm your understanding that this Site is available for the sole purpose of facilitating communications between health services providers and consumers who choose to use our online service.
Use of the Site
By using our Site, you confirm that you accept these Terms of Use and that you agree to comply with them. If you do not agree to these Terms of Use, you must not use our Site or access any of the Services.
Changes to These Terms and to the Site
We amend these Terms of Use from time to time. Every time you wish to use our Site, please check these Terms of Use to ensure you understand the conditions that apply at that time. Your continued use of the Site will mean that you accept those changes. We may update and change our Site from time to time to reflect changes to our products, our Users’ needs and our business priorities.
Other Applicable Terms
These Terms of Use refer to a Privacy Policy, which also applies to your use of our Site. The policy sets out the terms on which we process any personal data we collect from you or that you provide to us. By using our Site, you consent to such processing and you warrant that all data provided by you is accurate.
Suspension or Withdrawal of the Site
We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of our Site for any reason.
Account Safety
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion, you have failed to comply with any of the provisions of these Terms of Use.
We recommend that you do not access the Site to use the Services on public computers. We also recommend that you do not store your password through your web browser or other software, and that you provide a complex alphanumeric password as your access details. You may not transfer or share your password with anyone.
Accounts
To access IMH Tele services, you must create an account (“Account”). By signing up for an Account with us, you become a registered user with access to certain password-restricted areas of the Site and to use certain Services offered on and through the Site. Each Account is identified by a unique email address. You agree to create your Account accurately and truthfully, including but not limited to your email address, name, mobile telephone number, date of birth and password, and that such personal details are kept up to date. You agree that you are only communicating with us for the Services using your own Account and personal details (or, if relevant, that of a minor linked with your Account).
Your Account details are personal to you and you are solely responsible for maintaining their confidentiality, as you remain liable for all activity that occurs under your Account. You agree to prohibit anyone else from using your Account. We aim to reconcile duplicate member Accounts. If we identify multiple Accounts owned by the same User, we will automatically combine Accounts. You will be informed of this by email. It is your responsibility to inform us of any duplicate Accounts by contacting us at patientrelations@imh.ae
We make every effort to ensure consultations maintain a viable internet connection but we are not responsible for the internet or data bandwidth and signal of your mobile device, nor transmission errors. You assume total responsibility and risk for your use of this Site, the Service, and linked websites. We do not warrant that files available for download will be free of viruses, worms, trojan horses or other destructive programming. You are responsible for implementing procedures sufficient to satisfy your needs for data back up and security.
Credit Card Details
You agree, understand and confirm that the credit card details provided by you for availing of services on www.imh.ae will be correct and accurate and you shall not use the credit card that is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to www.imh.ae Further the said information will not be utilized and shared by www.imh.ae with any of the third parties unless required for fraud verifications or by law, regulation or court request. www.imh.ae will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively on you.
Cancellation by International Modern Hospital
Please note that there may be certain requests that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any request for any reason. Some situations that may result in your request being cancelled include limitations on quantities available for purchase, inaccuracies or errors in service or pricing information, or problems identified by our credit and fraud avoidance department, cases where we find that the customer is manipulating the account to place multiple requests. We may also require additional verifications or information before accepting any request. We will contact you if all or any portion of your request is cancelled or if additional information is required to accept your request. If your request is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account. No cash disbursement shall be made under any condition whatsoever.
Cancellations by the Customer
In case we receive a cancellation notice and the request has not been processed/approved by us, we shall cancel the request and refund the entire amount. We will not be able to cancel requests that have already been processed. www.imh.ae has the full right to decide whether a request has been processed or not. The customer agrees not to dispute the decision made by www.imhe.ae and accept International Modern Hospital’s decision regarding the cancellation.
Fraudulent /Declined Transactions
www.imh.ae reserves the right to recover the cost of services, collection charges and lawyers’ fees from persons using the Site fraudulently. www.imh.ae reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.
Electronic Communications
When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Use of Material on Our Site and Interaction with Platform Doctors
We are the owner or the licensee of all intellectual property rights on our Site, and in the material published on it. Copyright laws and treaties around the world protect those works. All such rights are reserved.
You must not modify any paper or digital copies of any materials or medical reports you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on our Site must always be acknowledged. You must not use any part of the content on our Site for commercial purposes.
If you print off, copy or download any part of the Site in breach of these Terms of Use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
We grant you a limited, non-exclusive right to access the Site and use the Services for our personal and non-commercial use as permitted herein. You agree that you will not use the Site to violate any applicable laws, distribute viruses or harmful computer code, or attempt to disassemble or reverse engineer any software on the Site.
You also agree to not engage in any abusive, inappropriate or unlawful behavior when communicating with the Site or the Platform Doctors. You agree not to contact, or attempt to contact, any Platform Doctors outside of the Site.
We are not responsible for websites we link to where the Site contains links to other sites and resources provided by third parties; these links are provided for your information only. Such links should not be interpreted as an approval or endorsement by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
We do not approve user-generated content. The Site may include information and materials uploaded by other users of the Site. This information and these materials have not been verified or approved by us. Any views expressed by other users on our Site do not necessarily represent our views or values. Uploading content to our site
Any content you upload to our Site will be considered non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited license to use, store and copy that content and to distribute and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy. We have the right to remove any posting you make on our Site if, in our opinion, your post does not comply with the content standards. You are solely responsible for securing and backing up your content.
You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our Site, the server on which our site is stored or any server, computer or database connected to our Site. By breaching this provision, you would commit criminal offence local criminal laws where you are located. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. We reserve the right to determine in which locations the Services are provided and make no representation that the Services available through the Site will be appropriate or available for use outside of any jurisdiction in which we expressly state that we operate.
Rules about linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
Provision of Health Services
By accessing the Site and using the Services, you acknowledge that you are accessing a licensed health facility located in Dubai, United Arab Emirates and governed by Dubai Health Authority (DHA). There will be times when International Modern Hospital physicians will not be able to provide an assessment using telehealth consultation. IMH Physicians are trained to assess the appropriateness for conducting telehealth consultations on a case-by-case basis. They will ensure that each consultation meets the standards required for patient examination and evaluation: if they are unable to make a full, adequate assessment for advice, based on high quality evidence, they will recommend you visit a doctor in a physical clinic.
Governing Law and Jurisdiction
This User Agreement shall be construed in accordance with the applicable laws of UAE. The Courts at Dubai shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by International Modern Hospital and his decision shall be final and binding on the parties hereto. The arbitration shall be held in Dubai. The laws of UAE shall be applicable in such aspects. Reviews, Feedback, Submissions
All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to www.imh.ae on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, the “Comments”) shall be and remain www.imh.ae property. Such disclosure, submission or offer of any Comments shall constitute an assignment to www.imh.ae of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, www.imh.ae owns exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. www.imh.ae will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any Comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. www.imh.ae is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay you any compensation for any Comments; or (3) to respond to any Comments.
